Introduction', 'These Rental Terms & Conditions (“Terms”) govern the rental of equipment from BrainPower Innovation Technology (“BrainPower”, “we”, “us” or “our”) to a customer (“Customer”, “you” or “your”). By making a rental booking, accepting delivery or handover of equipment, or otherwise proceeding with a rental, the Customer confirms that they have read, understood and agreed to these Terms.' ); self::render_section( '2. Customer Eligibility and Identification', 'BrainPower may require a customer to provide identification and other verification information before a rental is approved or handed over. BrainPower may collect and verify the Customer’s name, telephone number, email address, identification details, identification document, photograph/selfie and other information reasonably required to establish the Customer’s identity and rental account.' ); self::render_section( '3. Rental Booking', 'A rental booking identifies the equipment, rental period, applicable rental rate and other charges applicable to the transaction. The Customer is responsible for reviewing the equipment, rental period and applicable charges before completing the booking. Once a rental booking has been accepted and payment has been made, the Customer should treat the booking as a commitment to proceed.' ); self::render_section( '4. Cancellation and Refunds', 'BrainPower’s V1 rental policy is that paid rental bookings are generally non-refundable after the booking has been accepted. Customers are expected to confirm that they require the equipment before making payment. A change of mind, change of plans or decision that the equipment is no longer required does not automatically create a right to cancellation or refund. BrainPower may, at its discretion, consider exceptional circumstances and decide whether any adjustment, credit, refund or other resolution is appropriate. Where BrainPower is unable to fulfil an accepted rental because the equipment cannot reasonably be provided, BrainPower may provide an appropriate replacement, alternative arrangement or refund for the unfulfilled rental.' ); self::render_section( '5. Rental Period', 'The rental period begins and ends according to the booking, handover and return arrangements communicated by BrainPower. The Customer must return the equipment within the agreed rental period and in accordance with BrainPower’s return instructions.' ); self::render_section( '6. Late Returns', 'Where equipment remains with the Customer beyond the agreed return period, BrainPower may charge the applicable daily rental rate for each additional rental day or additional period determined by BrainPower. The applicable rate is the rental rate for the particular equipment being retained. Late return does not automatically create a new booking or guarantee continued availability. BrainPower may exercise reasonable discretion where a short delay occurs.' ); self::render_section( '7. Equipment Handover', 'At handover, BrainPower may identify the physical equipment by an equipment or asset identification number and record its condition and accessories. The Customer should inspect the equipment at handover and notify BrainPower of any visible issue not already recorded. Once handed over, the Customer is responsible for its care and proper use during the rental period.' ); self::render_section( '8. Customer Responsibility and Proper Use', 'The Customer must use the equipment responsibly, for its intended purpose and in accordance with operating instructions and safety requirements. The Customer must not misuse, abuse, modify, dismantle, sell, transfer, sub-rent, pledge or otherwise dispose of BrainPower equipment without express permission. The Customer must take reasonable steps to protect equipment from theft, loss, water damage, fire, avoidable impact and other preventable damage.' ); self::render_section( '9. Damage, Wear and Inspection', 'BrainPower may inspect equipment when it is returned. Normal wear arising from reasonable and proper use will be distinguished, where reasonably possible, from damage caused by misuse, negligence, abuse, accident, unauthorized modification or other circumstances attributable to the Customer. Where BrainPower determines that the Customer is responsible for damage, BrainPower may assess a reasonable charge based on the nature and extent of the damage and the cost of appropriate repair or remedial action.' ); self::render_section( '10. Damage Charges and BrainPower Discretion', 'A Customer may be liable for damage to equipment or accessories occurring during the rental period where the damage is attributable to the Customer. BrainPower retains discretion to assess each case. Depending on the circumstances, BrainPower may waive the charge, reduce the charge, apply a minor repair/service charge, require payment of a reasonable repair cost, or where equipment cannot reasonably be repaired or is otherwise lost, require an appropriate replacement or loss charge. Any waiver or reduction is discretionary.' ); self::render_section( '11. Missing Accessories', 'Where an item, accessory, component, charger, battery, case or other item supplied with the rental is not returned, BrainPower may record the missing item and assess a reasonable charge for its replacement or other appropriate resolution. BrainPower may, at its discretion, waive or reduce such a charge.' ); self::render_section( '12. Lost, Stolen or Unreturned Equipment', 'The Customer must promptly notify BrainPower if rented equipment is lost, stolen, destroyed or otherwise cannot be returned. Where equipment is not returned and BrainPower determines that the Customer is responsible, the Customer may be liable for reasonable loss or replacement costs together with applicable outstanding rental charges. BrainPower may take appropriate recovery, account-restriction or other lawful steps.' ); self::render_section( '13. Outstanding Customer Charges and Rental Hold', 'Where BrainPower assesses a valid charge arising from damage, loss, missing accessories, late return or another rental obligation and the Customer does not settle the amount immediately, BrainPower may record it as an outstanding charge against the Customer’s rental account. An outstanding charge may place the Customer’s account on a Rental Hold. While a Rental Hold remains active, BrainPower may require the outstanding amount to be settled before accepting or releasing another rental. The account may remain subject to the charge until paid, reduced, waived or otherwise resolved. BrainPower may maintain records of the assessment, reason, amount, payment status, authorization and resolution.' ); self::render_section( '14. Delivery, Pickup and Collection', 'Where delivery is selected, the Customer is responsible for accurate delivery information and being available to receive the equipment. Delivery, pickup or collection charges may apply as shown during the rental transaction. The Customer must cooperate with reasonable identification and handover procedures.' ); self::render_section( '15. Customer Accounts and Verification Records', 'BrainPower may maintain a customer account containing rental history, verification records, equipment transactions, handover and return records, outstanding charges, payment status and other information reasonably required to operate the rental service. Customers are responsible for keeping account information accurate and protecting credentials.' ); self::render_section( '16. Safety', 'Customers must operate rented equipment safely and only where they are competent and appropriately trained. The Customer is responsible for following manufacturer instructions, applicable safety requirements and reasonable precautions. BrainPower may refuse a rental or handover where it reasonably believes the intended use presents an unacceptable safety or equipment risk.' ); self::render_section( '17. Equipment Availability', 'Equipment availability is subject to actual fleet availability, maintenance status, prior bookings and operational requirements. Where a particular item becomes unavailable before handover, BrainPower may offer an alternative, reschedule the rental or provide another appropriate resolution.' ); self::render_section( '18. Refusal, Restriction or Termination of Rental', 'BrainPower may refuse, suspend or terminate a rental where there is a reasonable basis to believe that the Customer has breached these Terms, provided false or misleading information, failed verification requirements, failed to return equipment, has an unresolved outstanding charge, or presents a material risk to equipment, staff, customers or operations.' ); self::render_section( '19. Ownership of Equipment', 'All rented equipment remains the property of BrainPower or the relevant equipment owner. Rental does not transfer ownership to the Customer. The Customer must not represent rented equipment as their own or create any third-party interest in it.' ); self::render_section( '20. Changes to These Terms', 'BrainPower may update these Terms from time to time to reflect changes to its rental operations, equipment, services, systems or applicable requirements. The version of the Terms accepted by a Customer may be recorded with the Customer’s rental account.' ); self::render_section( '21. Governing Law and Disputes', 'These Terms are intended to be governed by the laws applicable in Nigeria, subject to final legal review and any mandatory rights or requirements applicable to the Customer. BrainPower encourages customers to raise concerns promptly so operational issues can be reviewed and resolved where possible.' ); self::render_section( '22. Customer Acceptance', 'Before completing a rental, the Customer should have access to the complete Rental Terms & Conditions and an opportunity to read them. Recommended acceptance statement: “I confirm that I have read and understood the BrainPower Rental Terms & Conditions and agree to comply with them.” Where technically available, BrainPower should record the Customer, date and time of acceptance and the version of the Terms accepted.' );
